Have you been Arrested?

The law categorizes domestic violence into degrees based on the severity of the crime, with first-degree offenses classified as Class A felonies, second-degree offenses as Class B felonies, and third-degree offenses as either Class A misdemeanors or Class C felonies for repeat offenses. Acts such as assault, stalking, burglary, and strangulation fall under these classifications. Additionally, victims of abuse can request a Protection From Abuse (PFA) order, which can provide legal safeguards against further harm. PFA orders apply statewide and can be obtained based on specific criteria, ensuring protection for those at risk of continued abuse.

If arrested for domestic violence, individuals should avoid making statements to law enforcement without legal counsel, as anything said may be used against them in court. The legal system prosecutes domestic violence cases aggressively, often issuing protective orders and detaining alleged aggressors to prevent further harm. DUI

Driving under the influence (DUI) is a serious offense in Alabama, carrying consequences that range from fines to jail time. A DUI charge can be classified as either a misdemeanor or a felony, depending on the number of prior offenses and the severity of the situation. Alabama law defines DUI as operating a vehicle with a blood alcohol concentration (BAC) of 0.08% or higher, or while visibly impaired due to alcohol, drugs, or other substances. Notably, Alabama allows DUI arrests even if the individual is not actively driving. Refusing a field sobriety test results in an automatic 90-day license suspension. A first-time DUI is considered a misdemeanor and can result in fines up to $2,100, jail time of up to one year, and a 90-day license suspension. Penalties increase with subsequent offenses, with a fourth DUI being classified as a felony, leading to harsher fines and longer incarceration.

DUI convictions in Alabama remain on an individual’s record for life, although offenses that occur more than five years apart are treated separately. While a fourth DUI is automatically a felony, other aggravating factors—such as serious injuries caused while driving under the influence—can also elevate the charge. License suspension is not always mandatory; first-time offenders with a BAC below 0.15% and no aggravating factors may opt for an ignition interlock device (IID) instead of suspension. Repeat offenders, however, must use an IID for extended periods, with second-time offenders requiring it for two years.
